Read Bill - HJR1067 - As Filed Bill Number: OK53RHJR1067 Filed: 01-13-2012 Author: Reynolds STATE OF OKLAHOMA 1 2nd Session of the 53rd Legislature (2012) 2 HOUSE JOINT 3 RESOLUTION 1067 By: Reynolds 4 AS INTRODUCED 5 A Joint Resolution directing the Secretary of State 6 to refer to the people for their approval or 7 rejection a proposed amendment to the Constitution of 8 the State of Oklahoma by adding a new Section 38 to 9 Article II; providing for applicability; prohibiting 10 the intentional killing of any innocent person; 11 providing for exceptions; defining terms; providing 12 ballot title; and directing filing. 13 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE 14 SENATE OF THE 2ND SESSION OF THE 53RD OKLAHOMA LEGISLATURE: 15 SECTION 1. The Secretary of State shall refer to the people 16 for their approval or rejection, as and in the manner provided by 17 law, the following proposed amendment to Article II of the 18 Oklahoma Constitution by adding a new Section 38 to read as 19 follows: 20 Section 38. A. With respect to the right to life, the term 21 "persons", as used in Section 2 of Article II of this 22 Constitution, applies to every human being from the beginning of 23 the biological development of that human being. 24 B. The intentional killing of any innocent person is 1 1 prohibited. 2 1. Only birth control that kills a person shall be affected 3 by this section. 4 2. Only in vitro fertilization and assisted reproduction 5 that kills a person shall be affected by this section. 6 3. Medical treatment for life-threatening physical 7 conditions intended to preserve life shall not be affected by this 8 section. 9 4. Spontaneous miscarriages shall not be affected by this 10 section. 11 5. No innocent child created through rape or incest shall 12 be killed for the crime of his or her father. 13 C. For the purposes of this section: 14 1. A "human being" is a member of the species homo sapiens 15 at any stage of development; 16 2. "Spontaneous miscarriage" is the unintentional 17 termination of a pregnancy; 18 3. "Child" includes a human being prior to and during 19 birth; and 20 4. "Medical treatment for life-threatening physical 21 conditions intended to preserve life" includes but is not limited 22 to treatment for cancer, ectopic and molar pregnancy, twin-to-twin 23 transfusion syndrome, and placenta previa. 24 SECTION 1. The Ballot Title for the proposed Constitutional 25 amendment as set forth in SECTION 1 of this resolution shall be in 26 the following form: 27 BALLOT TITLE 2 1 Legislative Referendum No. ____ State Question No. ____ 2 THE GIST OF THE PROPOSITION IS AS FOLLOWS: 3 This measure adds a new section of law to the Oklahoma 4 Constitution. It adds Section 38 to Article II. The purpose of 5 the amendment is to expand the class of human beings that 6 currently enjoy the inherent right to life under the Oklahoma 7 Constitution to include every human being, irrespective of age, 8 race, gender, disability, health, function, condition of 9 dependency, including physical or mental dependency, or method of 10 reproduction, from the beginning of the biological development of 11 that human being. 12 SHALL THE PROPOSAL BE APPROVED? 13 FOR THE PROPOSAL - YES _____________ 14 AGAINST THE PROPOSAL - NO _____________ 15 SECTION 1.
